Umka Terms of Use

1. Adults and family use

Umka is offered to a parent or legal guardian who is able to enter a binding agreement. You must be at least 18 years old, or the age of legal majority where you live, to set up Umka or purchase a subscription.

A child may interact with the learning portion of Umka only under the authority and responsibility of a parent or legal guardian. The adult is responsible for choosing the device, selected apps, approved time, learning level, questions, extra time, and other settings, and for deciding whether Umka fits the family. A child is not asked to purchase Umka or enter into these Terms directly.

2. How these Terms work with Apple's terms

Umka is distributed through Apple's App Store. Your license to the iOS app is governed by Apple's Standard Licensed Application End User License Agreement (Standard EULA). We have not replaced the Standard EULA with a custom EULA in App Store Connect.

These Terms supplement Apple's Standard EULA and govern the Umka service, the Umka website, subscriptions, support, and your relationship with Sfumato Studios. If these Terms conflict with the Standard EULA about the license to the iOS app, the Standard EULA controls. Apple's App Store and payment terms also control matters Apple handles, including billing and refunds. Mandatory law controls over both agreements where it requires a different result.

3. What Umka does

Umka supports a parent-chosen routine for selected apps on a supported iPhone or iPad. A parent chooses the apps, categories, or websites represented by Apple's controls and sets approved time. When that time is used, Umka can offer a short math practice before making a parent-set amount of extra time available.

Umka manages only the scope the parent selects. It does not lock the whole device, monitor messages, browsing, or location, or promise that a control is impossible to work around. The parent remains responsible for the family rule, device configuration, supervision, and access to essential, school, communication, or safety-related apps.

4. Apple Screen Time limitations

Umka relies on Apple's Family Controls, Managed Settings, and Device Activity frameworks. Apple controls authorization, system interfaces, background execution, and usage reporting. Screen Time thresholds and callbacks may occur later than a nominal limit, and operating-system changes, permissions, overlapping Apple App Limits, device settings, connectivity, or other factors may affect behavior.

Umka therefore does not guarantee exact-to-the-minute timing, uninterrupted availability, automatic opening from every system screen, or prevention of every workaround. You should review the setup and selected-app behavior on the device and keep an alternative family plan available when Apple-controlled features are unavailable.

5. Educational and family limitations

Umka provides short math practice. It is not a school, curriculum, tutoring, assessment, special-education, medical, mental-health, child-safety, or other professional service. Umka does not diagnose a learner or determine the amount of screen time that is right for a child.

Umka does not guarantee grades, proficiency, mastery, test results, behavior, motivation, reduced screen time, fewer disagreements, or any other educational or family outcome. Parents should use their own judgment and consult a qualified professional when professional advice is needed.

6. Subscriptions, trials, and purchases

If Umka offers a subscription, the subscription is purchased through Apple's In-App Purchase system and charged to the Apple Account that confirms the purchase. Before confirmation, Umka and Apple's purchase presentation will show the subscription product, duration, localized price, renewal terms, and any trial or promotional offer for which Apple determines you are eligible. Those specific terms presented at purchase control the transaction.

Subscriptions automatically renew unless canceled through Apple before the renewal deadline Apple displays. Apple may charge the renewal price to the Apple Account according to its terms. You can review or cancel a subscription in Apple Account Settings or at Apple's subscription-management page. Deleting Umka does not cancel an active subscription.

You can use Umka's Restore Purchases function, when available, to ask Apple to restore eligible purchases associated with the Apple Account. Apple controls payment processing and refund decisions. Refund requests must be made through Apple's refund process and are subject to Apple's policies and applicable law.

A trial or promotional offer is available only when shown as available to you by Apple. Unless the purchase presentation says otherwise, a trial converts to the displayed paid subscription when it ends unless canceled before Apple's deadline. We do not promise that a particular product, price, trial, or offer will remain available.

7. Privacy

Our Privacy Policy explains how Umka, the website, support communications, Apple purchase services, RevenueCat, and Vercel handle information. The Privacy Policy is incorporated into these Terms by reference. Do not send child answers, learning history, a Parent PIN, or selected-app information in a support message.

8. Acceptable use

You may use Umka and the website only for lawful, personal, and noncommercial family use. You may not:

• misuse Umka, the website, or another person's device or Apple Account;
• interfere with, damage, overload, probe, or attempt unauthorized access to Umka, its website, purchase systems, security features, or providers;
• copy, distribute, sell, lease, sublicense, or create derivative works from Umka or website content except as permitted by the Standard EULA, applicable open-source terms, or law;
• reverse engineer or circumvent technical protections except to the limited extent applicable law expressly permits despite this restriction;
• use Umka to violate another person's rights or any law; or
• misrepresent your relationship with Sfumato Studios or imply our endorsement.

9. Ownership and feedback

Umka, the website, their visual design, software, text, graphics, and other content are owned by Sfumato Studios or its licensors and are protected by applicable intellectual-property laws. The Standard EULA grants the app license; these Terms do not transfer ownership or grant additional rights except the limited right to access the public website for personal, noncommercial use.

If you voluntarily send suggestions or feedback, you give Sfumato Studios a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate that feedback without restriction or compensation. Do not include confidential information or a child's personal information in feedback.

10. Third-party services and links

Umka depends on services provided by Apple and may use providers such as RevenueCat for subscription infrastructure and Vercel for website hosting and aggregate web analytics. Third-party services are governed by their own terms and privacy practices. We are not responsible for third-party services or websites outside our control, but this does not limit responsibilities that applicable law does not allow us to exclude.

11. Availability, changes, and termination

We may update, suspend, or discontinue all or part of Umka or the website, and may change supported devices or features. We will provide notice or obtain consent when applicable law requires it. An operating-system or provider change may require us to alter or remove functionality.

You may stop using Umka at any time. Stopping use or deleting the app does not cancel an Apple subscription; cancellation is described in Section 6. We may suspend access to services we control if you materially violate these Terms or if reasonably necessary to protect Umka, users, providers, or legal compliance. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, and applicable payment obligations.

12. Disclaimers

To the fullest extent permitted by law, and in addition to the disclaimers in Apple's Standard EULA, Umka and the website are provided "as is" and "as available." Sfumato Studios disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that Umka will be uninterrupted or error-free, that Apple Screen Time behavior will be exact, or that the content will meet every family's needs. Some jurisdictions do not allow certain warranty exclusions, so these exclusions apply only to the extent allowed by law.

13. Limitation of liability

To the fullest extent permitted by law, Sfumato Studios and its members, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business interruption, arising from or related to Umka, the website, or these Terms, even if advised that such damages are possible.

To the fullest extent permitted by law, Sfumato Studios' aggregate liability for claims arising from or related to the Umka service, website, or these Terms will not exceed the greater of the amount you paid for Umka during the 12 months before the event giving rise to the claim or US $50. This limit does not apply to liability that cannot legally be limited, including where applicable liability for fraud, willful misconduct, death or personal injury caused by negligence, or violation of non-waivable consumer rights.

You may have warranties, remedies, or other rights under the law where you live that cannot be waived or limited. Nothing in these Terms excludes, restricts, or modifies those rights.

14. Changes to these Terms

We may update these Terms when Umka, the website, our providers, or legal requirements change. We will post the updated Terms and change the "Last updated" date. If a change materially affects an existing subscription or requires notice or consent, we will provide the notice or obtain the consent required by applicable law. A change will not retroactively reduce rights that cannot legally be reduced.

15. Applicable law and consumer rights

Apple's Standard EULA states the law that governs the app license. Other questions are governed by applicable law. If consumer law where you live gives you protections that cannot be waived, those protections remain in effect. No language in these Terms requires you to give up rights that cannot be waived or limited.
